Technically Speaking: SMSF Property Development (Part 1)

Part one of a two-part series unpacking a broad range of superannuation and taxation requirements SMSF trustees need to contemplate when considering property development.

Mary Simmons, the Association’s Technical Manager, has written this edition of Technically Speaking which explores the common issues that should be considered by SMSF trustees when engaging in property development including:

  • The raft of regulatory issues that stem from an SMSF undertaking property development or as part of carrying on a business;
  • The strict borrowing restrictions that apply;
  • The issues that can arise with related party builders; and
  • The importance of undertaking property development on commercial arm’s length terms irrespective of the relationship between parties.
